How do I remove a deceased person such as a husband or wife from my title or deed?

In general, so long as a living person remains on the deed, the living person can remove a deceased person through what is known as an affidavit in conjunction with a deed. Not all states recognize affidavits and have different rules on how to handle removing a deceased person from title when a living person still remains on the deed.

If the only person listed on the deed is now passed on, regardless if they have a Will or not, the property may be subject to probate. In that case, you will need to contact a probate attorney in the area or state where the property is located to seek proper legal advice on how to resolve the matter.
